Paraquat is a toxic weed and grass killer used in commercial crop operations. It is an RUP (Restricted Use Pesticide), which can only be purchased or used by certified “license applicators”. Paraquat has been commonly used on crops in America since the 1960s.

How Do I Become Exposed To Paraquat?

Paraquat is extremely toxic and just one teaspoon can cause death. Poisoning may occur by inhaling or ingesting the chemical and absorption of the chemical through the skin.

Since Paraquat is commonly used by farms, individuals living within close proximity to farms could be exposed to the chemical. Exposure could increase their risk of developing Parkinson’s and other diseases.

Skin exposure is another way to be exposed to paraquat. Skin exposure is more likely to cause harm if the exposure is over a long period or the paraquat is a concentrated version of the product. Exposure to skin that has a rash, sores, or cuts could increase the risk of injury.

Inhaling paraquat can cause lung damage. According to the CDC, paraquat has been found in marijuana in the United States. 

In October 2020, the EPA proposed new measures to reduce the risk of injury or harm from paraquat exposure. But, unfortunately, these measures are unlikely to prevent all paraquat injuries and accidents.

  • IMPAIRED POSTURE AND BALANCE. YOUR POSTURE MAY BECOME STOOPED, OR YOU MAY HAVE BALANCE PROBLEMS AS A RESULT OF PARKINSON’S DISEASE.

When Will The Paraquat Lawsuit Reach a Settlement?

We believe the Paraquat lawsuits will reach a settlement before the “bellwether trials. The outcome of the bellwether trials provide guidance to the litigants as to strength of their cases and the amount of jury verdicts.

Judge Rosentengel in the Federal Court MDL dismissed the first four bellwether cases on the grounds that plainitiffs failed to prove causation. The Judge struck plaintiff’s expert testimony, Dr. Martin Wells, on general causation.

This was a huge setback because it means that Plaintiffs were unable to establish the requisite causal link between Paraquat and Parkinson’s disease.

Plaintiffs’ lawyers in the federal court litigation are now working up new experts to prove causation. These experts will have to survive challenges by the defense.

The first bellwether trials in the Federal Court MDL are scheduled to start in 2025. Accordingly, most Paraquat attorneys believe a global settlement will be negotiated in 2025.

December 5, 2024 – California Judge Strikes Testimony of Plaintiff’s Expert

Judge Charles Treat, who presides over the consolidated Paraquat cases in California state court, entered an order striking the testimony of Plaintiff’s general causation expert, Dr. Martin Wells. This means that Dr. Wells’ testimony on causation is inadmissible. Of course, this is a huge blow to Plaintiffs because in order to prove causation, they need expert testimony.

Amazingly, this is déjà vu. We’ve posted before how in the federal MDL, the Plaintiffs hit a roadblock when the Judge excluded Plaintiff’s general causation expert.

Guess what? It is the same expert! Dr. Wells was the very expert who was excluded in the federal court MDL. Now, his testimony has also been deemed inadmissible in the California Paraquat litigation

December 3, 2024 – Will U.S. Ban Paraquat Under RFK Jr.’s Leadership?

Paraquat is a powerful herbicide that causes Parkinson’s disease. Its so toxic that 32 countries have banned it.

It is no secret that John F. Kennedy, Jr. has a disdain for pesticides and herbicdes, including Paraquat. Assuming RFK Jr. is the new Secretary of Health and Human Services, he will have alot of power in placing restrictions on herbicides that have harmful effects.

Under RFK Jr.’s leadership, there is a real possibility the U.S. takes action similar to European countries. No doubt, the agriculture industry does not want any restrictions on using herbicides. To achieve his goal, RFK Jr. will have to overcome a well funded lobbying group. We wish RFJ Jr. the best of luck.

November 11, 2024 – Philadelphia Paraquat MDL Update

The first trial in the Paraquat litigation that’s in Pennsylvania state court is set for April 2025. The parties have exchanged expert reports. Motions to strike expert reports are due in December 2024.

We expect a ruling from the court on the admissibility of expert testimony the first part of 2025. This ruling is highly anticipated because plaintiffs in the federal court MDL were unable to move forward with their initial experts.

The Pennsylvania MDL highlights a more common strategy in mass torts. If the going gets tough in federal court, try to suceed in state court MDLs. All eyes are on the April 2025 trial in Philadelphia.

October 13, 2024 – 47 Congressmen Ask EPA to Ban Paraquat

Congressman Greg Casar (D-Texas) and 46 other members of Congress are calling on the EPA to ban the use of Paraquat. Paraquat is already banned in over 70 countries.

September 2024 – 10 Bellwether Cases Selected in Federal Court MDL

Judge Rosentengel selected ten new bellwether cases that will go to trial. Like before, the defense will try to exclude Plaintiffs current experts. Our best guess is that the first federal court trials will begin Summer of 2025.

August 2024 – Pennsylvania State Court MDL

In addition to the MDL in federal court, there are also Paraquat cases being litigated in Pennsylvania state court. This court has set the first Paraquat case for trial in April 2025. Assuming it moves forward, the trial will occur in Philadelphia, which is a plaintiff friendly venue.

May 09, 2024 – Tennesee Resident Files Paraquat Lawsuit

A farmer and resident of Tennessee filed a lawsuit against Syngenta alleging he was diagnosed Parkinson’s caused by Paraquat. The case will be transferred to the MDL Court overseeing the Paraquat litigation. If the case is not resolved through the MDL, the case may get transferred back to federal court in Tennessee.

The Risk Of Parkinson’s Disease Is Real

A study conducted by the NIEHS (National Institute of Environmental Health Sciences) found that exposure to certain pesticides like Paraquat increases the odds of developing Parkinson’s Disease by 2.5 times.

There have been multiple paraquat exposure studies administered on animals. A recent study by the University of Rochester reflects that paraquat exposure caused changes to the brain of mice and the loss of smell.
