What Is A Bard PowerPort Catheter?

The Bard PowerPort is an implanted medical catheter device underneath the skin that makes it easier for patients to receive repeated injections into the bloodstream.

This catheter device is also called an Injection Port, Port-a-Catheter, Port-a-Cath, and Totally Implantable Venous Access Device (TIVAD).

These devices allow for intravenous (or IV) delivery of fluids, medication, and nutrition without requiring the reinsertion of an IV for every injection. 

What Are The Problems With The Bard PowerPort Device?

The Bard PowerPort device contains Chronoflex AL and other non medical grade components.

According to Chronoflex’s MSDS sheet, its decomposition is hazardous. The catheter devices may decomposes inside the human body after Chronoflex oxidizes with blood and human tissue.

October 2, 2024 – MDL Continues to Grow at Steady Pace

The Bard litigation grew around 100 cases in August and 90 cases in September. As a result, the total number of filed cases is approximately 550.

September 2, 2024 – Plaintiffs Want Becton Dickinson in the Case

One of the early battles in the litigation has to do with “succesor liability”. The company that currently owns CR Bard, Inc. (Bard) is Becton Dickinson (BD). However, BD did not own Bard at the time the defective ports were manufactured. Successor liability is a legal theory that imputes liability onto the successor company, which in this case is BD. Of course, Plaintiffs want to win this battle so that deep pocketed BD is a defendant and on the hook for Bard’s negligence. BD will obviously put up a big fight. If the Court rules that BD has sucessor liability, then the Plaintiffs will get a big win.

August 4, 2024 – Next Status Conference Set For August 16, 2024

There is not much to report in the Bard PowerPort litigation. The next status conference is scheduled for August 16, 2024. The purpose of the status conference is for the parties to inform the Judge of scheduling issues and the generally roadmap of the litigation.

July 21, 2024 – Lawsuits Filed In New Jersey State Court

In addition to the MDL in Federal Court, plaintiffs are starting to file lawsuits in New Jersey state court. So far, roughly 50 cases have been filed in the the Superior Court of New Jersey. These days we are often seeing concurrent state court MDL’s like in the Paraquat litigation. The reason plaintiffs would file in New Jersey is because they want to be that venue. In many cases, state court MDLs offer advantages over federal court such as jury pools and selection.

July 10, 2024 – The Parties Narrow List of Prospective Bellwether Cases

In the Federal Court MDL, the parties selected 24 prospective Bellwether cases. A “Bellwether” is a case that serves as a test trial in mass litigation. Typically, mass litigation does not settle until after a number of Bellwether cases. From the list of 24, the firt round of test cases will be selected and set for trial.

July 2, 2024 – Roughly 300 Cases Have Been Filed

The Bard lawsuit continues to grow slowly. Roughly 300 cases have been filed in the MDL. Due to the very technical nature of these cases, we have found that cases are difficult and time consuming to vet. This is likely why cases are filed at a slow rate. This is not a bad thing as it is wise to file fully vetted cases.

June 4, 2024 – Georgia Resident Files Bard PowerPort Lawsuit

A resident of Georgia filed a lawsuit against Bard alleging a PowerPort cather device broke causing severe injuries to his organs. The case will be transferred to the MDL Court overseeing the Bard PowerPort litigation. If the case is not resolved through the MDL, the case may get transferred back to federal court in Georgia.

May 1, 2024 – Bard Powerport MDL Grows Slowly

The 50 PowerPort cases filed last month pushes the total number of cases filed in the MDL to just under 400. This litigation is growly at a slow pace, likley because of the technical nature of the lawsuits and time it takes to investigate claims.

April 2, 2024 – Deadline to Submit Plaintiff Profile Forms Is Near

In MDLs, plaintiffs are often requried to submit “Plaintiff Profile Forms” [PPF] which contain specific medical and personal information.

In this litigation, the deadline to submit PPFs is May 1, 2024. Plaintiffs who fail to timely produce their PPFs risk getting their cases dismissed.

March 5, 2024 – Bellwether Selection Pool Closes April 1st

The deadline for filed cases to be considered for the bellwether selection process is April 1st. A “bellwether” is like a test trial in mass tort litigation. These test trials allow for the parties to evalaute the strengh and weaknesses in the litigation. Cases filed into the MDL docket after April 1st will not be considered for bellwether selections. As of now, roughly 110 lawsuits have been filed.

November 2, 2023 Parallel MCL Filed In New Jersey State Court

A parallel MCL (multi-county litigation) has been filed in New Jersey state court seeking to consolidate over 500 PowerPort lawsuits. Bard is headquartered in New Jersey. If the MCL is formed, then there will be two class actions. One in New Jersey state court and the other in federal court.

October 25, 2023 – Number of Filed Lawsuits Increase

We are continuing to see an increase in PowerPort lawsuits filed into the MDL. Over 62 lawsuits have been filed. We expect the number to increase into the hundreds over the next year.

October 6, 2023 – Judge Campbell Approves Plaintiff Leadership

Judge Campbell entered Case Management Order No. 1 (CMO-1) selecting the lead counsel for plaintiffs. The order also appoints plaintiffs’ counsel to various litigation committees. This is standard in a MDL. Each committee has a role to help move the litigation forward in an efficient and structured manner.
