ArticlesIf you search for the best personal injury lawyer in Birmingham, AL online, you’ll come across page after page of directory listings, sponsored rankings, and content written by marketing companies that have never set foot in an Alabama courtroom.
Here’s the truth: many of the well-known names in Alabama personal injury law are no longer actually trying cases. The lawyers in TV ads typically don’t litigate. The “Top Rated Personal Injury Attorney” badges you see plastered on websites are often paid placements or directory inclusions, not measures of actual courtroom skill.
So I made my own list.
I’m Fob James, IV, and I’ve practiced as a Birmingham personal injury lawyer for years, handling everything from car accident cases to complex trials. I see who is actually litigating cases. I know who other plaintiff lawyers respect, who insurance defense attorneys fear, and who is winning verdicts that few attorneys could pull off.
The five lawyers below are, in my honest opinion, the best personal injury lawyers practicing in Birmingham and across Alabama right now.
We hope that you choose to reach out to us to talk about your case, but even if you choose not to hire our law firm for your case we want to ensure that you find the right legal representation for your case.
If my wife or one of my kids were injured by a negligent party—and Fob James Law Firm could not handle—who would I hire to represent them? I would hire one of the attorneys listed in this article. — Fob James, IV
I want you to find the right legal representation for your case — even if that’s not me. The lawyers below would all be excellent choices.
How I Selected These Attorneys
Before getting to the list, I want to be transparent about what went into this ranking — because most “best lawyers” lists you’ll find online are either pay-to-play directories or thinly-disguised marketing for the firm publishing the list.
This list is neither. I am not paid to include them. This is my honest opinion based on years of observation in Alabama plaintiff’s law.
The criteria I used:
This is not a comprehensive ranking of every excellent personal injury lawyer in Birmingham. There are other strong attorneys whose work I respect. But these five are the ones I would personally call first.
Why You Shouldn’t Just Hire the Lawyer with the Most Billboards
A warning that may save you significant money: don’t choose your personal injury lawyer based on advertising volume.
The Alabama legal market includes a number of high-volume, heavily-advertised firms whose business models depend on settling cases quickly rather than litigating them effectively. These firms, often referred to in the legal community as “settlement mills”, operate on a few principles that may not align with your interests:
This is not to say all heavily-marketed firms are bad. Some have skilled attorneys. But marketing volume tells you nothing about whether a firm will actually litigate your case effectively, and high-visibility branding is often a red flag rather than a positive signal.
When the stakes are high, whether a serious injury, a wrongful death, or a case with disputed liability, you want a lawyer who actually goes to court and wins. The five lawyers below all do.

My Top 5 Best Personal Injury Lawyers in Birmingham, AL
1. Andrew Moak
Attorney Bio Page | Contact Information
Andrew Moak is, in my opinion, one of the best personal injury lawyers in Alabama. If the plaintiff’s bar ranked the best personal injury attorneys in the state, I would not be surprised if Andrew was number one.
What puts Andrew on the Mount Rushmore of Alabama trial lawyers is his ability to obtain nuclear verdicts in cases that have “bruises” on them. It is one thing to cherry-pick clean cases in good venues. It takes a whole different level of skill to obtain record verdicts, like Andrew does, with imperfect cases in tough venues.
In Morgan County, Alabama, Andrew achieved a remarkable $25 million verdict in a challenging pedestrian case. The case involved disputed liability against a driver. The driver’s insurance company denied the claim, arguing that Andrew’s client had walked the wrong way down a street at night while wearing dark clothing. Andrew smartly prosecuted the case on wantonness (recklessness) which negated the defendant’s contributory negligence defense.
In Montgomery County, Andrew and Brett Turnbull won a $15 million jury verdict for the estate of a foster child who died after the foster parents and DHS failed to properly administer prescription medication. Filed in 2015, the case involved complex legal and factual hurdles — including immunity defenses and significant “bruises.” Nevertheless, Andrew and Brett successfully held the responsible parties accountable.
2. Brett Turnbull
Attorney Bio Page | Contact Information
In my twenties, I lived in Las Vegas and played high-stakes No Limit and CAP No Limit Texas Hold’em. When I think of a personal injury lawyer who excels in high-stakes cases, I think of Brett Turnbull.
Brett can handle a $100 million case without letting the pressure affect him. He is fearless and has taken on the biggest cases against the most well-funded companies across the country.
Brett is recognized for securing a $25 million verdict against Nissan. This case involved a brake failure and was high profile, representing the victims’ family in California.
In Lee County, Alabama (an extremely tough venue for plaintiffs), Brett won a $9 million jury verdict for the estate of a young woman whose doctor prescribed birth control pills that caused a fatal blood clot in her lung. A $9 million verdict in an Alabama medical malpractice case is enormous given how restrictive Alabama’s medical malpractice law is. Verdicts like these in non-plaintiff-friendly venues are what separate Brett from the field.
Brett is also a trailblazer in traumatic brain injury cases. His work in this area has brought a new understanding to what is often a misunderstood, misdiagnosed, and undervalued injury.
3. Kendall Dunson
Attorney Bio Page | Contact Information
I have never personally met Kendall Dunson, but based on his reputation, I would not hesitate to retain him to represent a family member in a wrongful death or catastrophic injury case. Kendall’s results in automotive product liability cases speak for themselves and rival those of any trial lawyer in the country.
Kendall has obtained numerous jury verdicts in high-stakes defective design and rollover cases. In June 2023, Kendall and his team at Beasley Allen obtained an $8.5 million verdict against Nissan in Mobile, where Nissan designed a defective airbag that caused total blindness and permanent damage to the plaintiff’s eyes.
Kendall was also part of the Beasley Allen trial team that secured a $152 million verdict in 2019 against Ford. Kendall’s client was paralyzed after a negligently designed vehicle rolled over.
In September 2024, Kendall and the Beasley Allen trial team won a $160 million verdict against Daimler Trucks. Due to the lack of a pull-down safety seat in the truck cab, the collision left Beasley Allen’s client a quadriplegic.
The bottom line is Kendall is among the best product liability attorneys in the country, much less Alabama.
4. Ray Kermani
Attorney Bio Page | Contact Information
Ray Kermani, recently admitted to the Alabama bar, is an experienced trial lawyer who has won many “verdicts of the year” nationwide.
Ray is often asked by other trial lawyers to “parachute” into cases right before trial. He is also in high demand as an instructor at various trial schools — a recognition by his peers that he is among the best at the actual craft of trial advocacy.
Ray’s skills were on full display in 2023 when he obtained a $51.3 million verdict on behalf of a construction worker. Ray’s client was electrocuted on the jobsite after the defendant failed to follow safety procedures. Even though the case was tried in a very conservative county, the jury awarded one of the largest verdicts in California that year.
Ray Kermani is a gifted trial lawyer who is in his prime. If you have a case where the outcome at trial really matters, he is one of the few attorneys I would call.
5. Nate Vanderveer
Attorney Bio Page | Contact Information
I have always found Nate Vanderveer to be a professional of the highest caliber and a skilled personal injury lawyer. Nate and I have actually worked together on a case where we recovered millions of dollars on behalf of retirees whose life savings were stolen.
Nate is a top personal injury attorney in Birmingham who handles many types of plaintiff cases. He is also one of the few attorneys still fighting the good fight on medical malpractice cases in Alabama.
Most plaintiff firms in Alabama do not handle medical malpractice cases. The reason is that Alabama’s medical malpractice law makes it virtually impossible for a law firm to be profitable on most med-mal cases. Of course, no client cares about the profitability of a law firm — but the reality is that when the risk and cost of prosecuting a certain type of case is high, few lawyers will handle such cases. This is what has largely happened with medical malpractice cases in Alabama, but it has not deterred Nate. I have immense respect for Nate and consider him a mentor.
How to Vet Any Lawyer on This List (or Off It)
Whoever you are considering, run the same checks I would run. Start with the license: the Alabama State Bar’s find-a-member directory confirms a lawyer is licensed and in good standing, and it is the first place I look before anything else.
- Confirm the license and standing with the State Bar, not the firm’s own website.
- Look for actual trial results and verdicts, not ad volume.
- Read reviews somewhere the firm does not control, and read the bad ones first.
- Ask who will actually work your file day to day. At high-volume firms it is often not the name on the door.
- Use the free consultation to ask when the lawyer last tried a case to a jury.
Frequently Asked Questions
Who are the best personal injury lawyers in Birmingham, Alabama?
In my honest opinion as a practicing Alabama trial lawyer, the five best personal injury lawyers in Birmingham are Andrew Moak, Brett Turnbull, Kendall Dunson, Ray Kermani, and Nate Vanderveer. Each of these attorneys has demonstrated real trial skill, recent meaningful verdicts, and the ability to win difficult cases, not just settle clean ones.
How do I choose the right personal injury lawyer in Birmingham?
Focus on actual trial experience, not advertising. Ask any prospective attorney how many cases they have personally tried to verdict in the last five years, what their results were, and whether you will work directly with them or with a case manager. Look for attorneys whose recent results (not decades-old reputation) demonstrate they can win difficult cases in tough Alabama venues. Insurance companies track which lawyers will and won’t actually try cases, and they offer accordingly. Read our complete guide to choosing the right Birmingham car accident lawyer →
Should I hire the personal injury lawyer with the most TV ads?
In my view, generally no. The lawyers with the most television advertising are typically running high-volume settlement operations rather than actually trying cases. The lawyer in the commercial often does not personally handle individual cases, and a heavy advertising budget has to come from somewhere — typically from accepting lower settlements or churning cases. This is not universally true, but as a general rule, advertising volume tells you nothing about courtroom skill, and it is often a warning sign rather than a positive signal for serious cases.
What’s the difference between a settlement mill and a trial firm?
A settlement mill is a high-volume law firm that resolves cases primarily through quick settlements rather than litigation. These firms often handle hundreds of cases per attorney, rely heavily on paralegals, and rarely try cases. A trial firm, sometimes called a boutique firm, handles fewer cases, gives each one substantial attorney attention, and is willing and able to invest money in the cases and take cases to verdict when necessary. Insurance companies offer dramatically different settlements based on whether a firm will actually go to trial. For minor cases with clear liability, a settlement mill may be adequate. For serious injuries or disputed cases, a trial firm typically produces better outcomes.
How much does a personal injury lawyer cost in Birmingham?
Almost all reputable personal injury lawyers in Birmingham, including our firm, work on a contingency fee basis. This means you pay nothing upfront. The attorney advances all case costs (expert witnesses, court filing fees, depositions, investigation expenses), and only takes a fee if you recover compensation. Standard contingency fees in Alabama personal injury cases are typically 33% if the case settles before a lawsuit is filed and 40% if a lawsuit is filed and litigated. If the case is lost, you generally owe nothing: no fee, no costs.
What questions should I ask in a free consultation?
Ask: (1) How many cases have you personally tried to verdict in the past five years? (2) Will I work directly with you, or with a case manager or paralegal? (3) What is your fee structure, when exactly does it change, and what costs do you advance? (4) Can you show me three case results for injuries similar to mine? (5) What is your honest assessment of the strengths and weaknesses of my case? (6) What are the biggest challenges this case presents? Watch for evasive answers, pressure to sign immediately, or unrealistic promises about specific dollar amounts.
Do I need a Birmingham-based lawyer for an Alabama personal injury case?
Not necessarily. Alabama personal injury law applies statewide, and many excellent Alabama trial lawyers handle cases anywhere in the state. However, there are practical advantages to having an attorney with specific Birmingham experience: familiarity with Jefferson County Circuit Court judges and procedures, established relationships with local accident reconstruction experts and Birmingham medical providers, and an understanding of how Birmingham juries differ from juries in other Alabama venues. For most serious cases, attorney skill matters more than geographic proximity, but local knowledge is meaningful.
What is “trial experience” and why does it matter?
Trial experience means an attorney has actually presented cases to juries and obtained verdicts — not just settled them. This matters because insurance companies systematically offer different settlement amounts depending on whether they believe an attorney will actually take the case to trial. An attorney who has never tried a case has limited credible leverage in negotiations. An attorney with a track record of jury verdicts (particularly verdicts in tough venues or tough cases) has substantially more leverage. The threat of trial is what drives meaningful settlements, but only if the threat is credible.
How long do personal injury cases take in Birmingham?
Timelines vary widely. Simple cases with clear liability and adequate insurance may settle within a few months once medical treatment is complete. Complex cases involving disputed liability, serious injuries requiring extensive treatment, or litigation can take 24 months or longer. The timeline is largely driven by the length of medical treatment (you typically should not settle until you reach maximum medical improvement) and whether litigation is necessary. Why trust this list over Super Lawyers, Avvo, or other directories?
Most lawyer rankings you’ll find online are either pay-to-play directories (where attorneys pay fees for inclusion or higher placement), peer-nomination services with limited validation, or marketing-driven content created by SEO companies with no actual knowledge of the lawyers being ranked. This list is none of those things. I am a practicing Alabama trial lawyer, and I have observed these attorneys’ work directly through reputation in the legal community, reported verdicts, and case results. That doesn’t make this list definitive, but it is an honest assessment.
